Hospitality Industry Employment Risks: Hotels And Restaurant Groups Begin Limiting Employee Hours To Below 30 Hours Per Week To Avoid Health-Care Law Requirements

Several restaurants, hotels and retailers have started or are preparing to limit schedules of hourly workers to below 30 hours a week. That is the threshold at which large employers in 2014 would have to offer workers a minimum level of insurance or pay a penalty starting at $2,000 for each worker.

The shift is one of the first significant steps by employers to avoid requirements under the health-care law, and whether the trend continues hinges on Tuesday’s election results. Republican presidential nominee Mitt Romney has pledged to overturn the Affordable Care Act, although he would face obstacles doing so.

Pillar Hotels & Resorts this summer began to focus more on hiring part-time workers among its 5,500 employees, after the Supreme Court upheld the health-care overhaul, said Chief Executive Chris Russell. The company has 210 franchise hotels, under the Sheraton, Fairfield Inns, Hampton Inns and Holiday Inns brands.

“The tendency is to say, ‘Let me fill this position with a 40-hour-a-week employee.’ “Mr. Russell said. “I think we have to think differently.”

Pillar offers health insurance to employees who work 32 hours a week or more, but only half take it, and Mr. Russell wants to limit his exposure to rising health-care costs. He said he planned to pursue new segments of the population, such as senior citizens, to find workers willing to accept part-time employment.

He described the shift as a “cultural change” toward hiring more part-timers and not a prohibition against hiring full-timers.

CKE Restaurants Inc., parent of the Carl’s Jr. and Hardee’s burger chains, began two months ago to hire part-time workers to replace full-time employees who left, said Andy Puzder, CEO of the Carpinteria, Calif., company. CKE, which is owned by private-equity firm Apollo Management LP,  offers limited-benefit plans to all restaurant employees, but the federal government won’t allow those policies to be sold starting in 2014 because of low caps on payouts. Mr. Puzder said he has advised Mr. Romney’s campaign on economic issues in an unpaid capacity.

Hospitality Industry Insurance Risks: Restaurant Operators Face "Financial Hit" From New Health Insurance Benefit Programs That Take Effect In 2014

Under the Patient Protection and Affordable Care Act, companies with 50 or more full-time eligible workers must either provide basic coverage by Jan. 1, 2014, or face fines of $2,000 per employee. A full-time employee is defined as one averaging 30 or more hours per week over a 60-day period.

“We will have a financial hit,” said CEO Victor Ansara. “We first thought it was going to be $300,000, but maybe only $100,000 to $200,000. We just don’t know how many of our employees in their 20s, who are pretty healthy, will want coverage.”

Farmington Hills-based Ansara Restaurant Group, which operates 22 Red Robin outlets and five other restaurants in Michigan and northern Ohio, is bracing financially to expand its health insurance benefit program by as many as 665 full-time workers to accommodate expected federal health care reform.

The first 30 employees are excluded from the penalty. For example, an employer with 75 employees would pay the penalty for 45 workers, or $90,000.

Eligible employees that reject insurance coverage by their employer would have to pay a $95 tax, or 1 percent of income, whichever is greater, in 2014. The tax rises to $325 in 2015 and to a maximum of $695, or 2 percent of income, in 2016. Family coverage taxes would be about three times higher in those years. The penalty is estimated to raise $6.9 billion in 2016, said the Congressional Budget Office.

Ansara said his company covers about 130 management staff with various plans from Blue Cross Blue Shield of Michigan and Blue Care Network. Only about 35 of its estimated 350 eligible hourly workers have opted for the coverage, he said.

“It is very difficult to plan when we don’t know what our health care costs are going to be in 2014,” he said. “To comply with the regulation, we have to offer coverage to all full-time eligible employees.”

Of Ansara’s 2,300 employees, up to 700 hourly workers could become eligible for health insurance coverage, he said.

Hospitality Industry Health Risks: North Carolina Restaurant Settles "Food Contamination" Class-Action Lawsuit For $375,000; Hundreds Had To Be Vaccinated For Hepatitis Virus

“…the lawsuit alleged that the restaurant chain exposed customers to potentially contaminated food or people, cost them wages and medical expenses, and caused fear and physical pain…a $375,000 fund has been set up by the restaurant’s parent company… to settle a class-action lawsuit…”

A lawsuit has been settled involving hundreds of people who had to be vaccinated after eating at a Fayetteville restaurant last year. The Fayetteville Observer reported those who were immunized after eating at the Olive Garden restaurant are eligible for payments of up to $250.

Hundreds of people got vaccinations after learning that one of the restaurant’s workers had tested positive for the virus, which causes liver inflammation.

Florida-based GMRI denied any wrongdoing but said it wanted to settle to end the litigation.

Hospitality Industry Health Risks: Washington Restaurant Closed Down By Health Department After Confirmation Of Salmonella Poisoning

“…(the Health Department) closed the restaurant this morning as a further precaution to reduce the risk of Salmonella spreading to others. Our staff is interviewing employees and patrons to learn more about the possible source of this outbreak, such as a contaminated food source.”

The Clark County Public Health Department is closing the On the Border Mexican restaurant in Vancouver, Washington after an outbreak of Salmonellaamong patrons. The restaurant is located at 1505 SE 164th Avenue. So far, there are 11 confirmed cases and 5 probable cases associated with this outbreak. Public health officials are asking that anyone who ate at the restaurant between September 20 and October 8, 2012 and experiencing symptoms of salmonellosis contact a health care provider.

The symptoms of Salmonella food poisoning include diarrhea, which may be bloody, fever, chills, abdominal cramps, and vomiting. People usually become ill one to three days after infection. Attorney Elliot Olsen said, “facilities that sell food are supposed to ensure that their product is safe. Food contaminated with pathogenic bacteria is not fit to eat.”

Since Salmonella infections can spread person-to-person, government officials are stressing the need for thorough hand-washing after using the bathroom, and before and during food preparation. Anyone who is ill should stay home and not prepare food until their symptoms have disappeared.

Hospitality Industry Health Risks: "Wrongful Death" Lawsuit Filed Against Illinois Hotel For Legionnaire's Disease Outbreak Tied To Fountain In Lobby

“…Health officials tied the outbreak to the main fountain in  the hotel lobby. The plaintiff …alleges the  hotel didn’t properly maintain the fountain and said the company neglected to  prevent visitors from walking near the fountain when the hotel should have known  about the bacteria…”

The family of a Florida man who died after catching  Legionnaire’s disease at a Loop hotel has filed a wrongful death suit against  Marriott International. Luis Enrique Acevedo Muro was one of three people who died  after being exposed to Legionella bacteria at the JW Marriott Chicago Hotel, at  151 W. Adams St., according to the lawsuit and public health officials.

Acevedo Muro, of Key Biscayne, Fla., contracted Legionnaire’s  disease after  staying at the hotel from Aug. 1 to Aug. 3, the suit claims. He  died Aug. 14.

The eight-count suit, filed Wednesday in Cook County Circuit  Court,  claims wrongful death and survival action against Marriott and   Chicago-based developer The Prime Group, Inc.  It seeks an unspecified  amount in  damages. Neither company could be reached for comment Wednesday evening.

Legionnaires’ disease is contracted by breathing in mist or  vapors from water contaminated with the Legionella bacteria and usually develops  two to 14 days after exposure. It frequently begins with headache, high fever  and chills, and progresses by the second or third day to include a cough, chest  pain and shortness of breath.

Hospitality Industry Crime Risks: "Strong Smell" Leads Police To Meth Lab In Florida Motel Room

“…It’s  a huge public safety issue. The chemicals involved are volatile, can be volatile especially when mixed together. People that don’t know what they’re doing, even people who are experienced at cooking, still cause fires, explosions…”

Two men are accused of setting up a meth lab in a Tallahassee motel. It happened at the Super 8 motel on North Monroe Street.  Deputies say a tip led them to room 229 and the strong smell led them to a meth lab inside.

Jack Peppers and Kevin Smith – both of Thomasville – are accused of trafficking in meth, manufacturing meth and having the ingredients to make more. Deputies say one batch of the meth was ready and divided up for use.  Another batch, they say, was being chemically cooked upstairs.

“The dry product, we had about 16 grams which is worth about $1600 on the street which is pretty significant for what they consider a small lab,” said SGT Ed Cook with LCSO’s Vice and Narcotics Unit. “They also had another 500 grams of product that was still cooking.”

Deputies had to ventilate the room for hours before going inside to clean it up.  They say all of the adjoining rooms were vacant so they did not have to evacuate any other motel guests.

Hospitality Industry Health Risks: New York Hotel Evacuated And Guests Taken To Hospital After "Potent Chlorine Fumes" Accidentally Released

“…A lifeguard who was mixing chemicals at an Upper East Side hotel pool accidentally unleashed potent chlorine fumes that forced  a partial evacuation of the building and injured five Wednesday…Four people were taken to New York Hospital and a  firefighter was rushed to Lenox Hill Hospital with chlorine inhalation after the 8 a.m. incident…”

All were in stable condition after the release, which forced hotel staff to  clear the lobby and lower level, according to Bill Pierce, the hotel’s director  of sales. FDNY Deputy Chief Dan Donoghue said the fumes came from the basement where a  lifeguard was mixing chemicals.

“The chemicals were stronger than the lifeguard thought,” Donoghue said.  “There was a reaction and basically we have a heavy odor of chlorine.”

One of the victims was the lifeguard, according to the FDNY official.

Hospitality Industry Health Risks: Health Department Confirms Deaths Of Two Chicago Hotel Guests After Exposure To Bacteria Causing Legionnaires' Disease

“…Health officials said Monday that two people have died of Legionnaires’ disease after being exposed to the bacteria that causes it at the JW Marriott Hotel…”

Last week, the hotel issued a warning to all recent guests, and began the complicated process of notifying the 8,500 guests who stayed there from July 16 through Aug. 15 that they may have been exposed to the bacteria known to cause serious and sometimes fatal bacterial infections, ABC Chicago reports.

The bacteria, Legionella, spreads through the inhalation of contaminated water vapor, and can cause Legionnaire’s disease, a severe form of pneumonia, Fox Chicago reports. Symptoms include headache, chills, chest pain and fever.

The disease often mirrors regular pneumonia, and can only be confirmed by a urine test, infectious disease expert Dr. John Segreti told CBS Chicago. Dr. Kathy Ritger with the Department of Public Health told WBEZ that not all exposures lead to illness, but any recent guests experiencing respiratory problems should seek medical attention.

Hospitality Industry Safety Risks: Multistory Hotels Face Increased Fire Risk From "Elevator Lift Shafts" That Provide "Ready Pathway For Toxic Smoke And Fire" To Travel Upwards

“…lift shafts provide a ready pathway for smoke and fire to travel upwards in multi-storey buildings.  Buoyant fire gases in a lift shaft can quickly fill upper floors, and there is much evidence to suggest that the majority of fatalities in such fires occur on higher floors significantly removed from the seat of the fire…”

Fires involving lift shafts pose particular risk in hotels where there can be large numbers of people, some of whom may be elderly or infirm, and in an unfamiliar place.  In 2007 alone, it’s estimated that one in 12 hotels and motels in the USA suffered a structural fire. 

That was certainly true in 1980 MGM Grand Hotel fire in Las Vegas which claimed 84 lives, the worst disaster in Nevada history.  In that incident, while the fire primarily only damaged the second floor, most of the deaths occurred on the upper floors, with elevator shafts and stairwells allowing toxic smoke to spread upwards.

It’s hard to overestimate the impact this fire had on both our understanding of vertical fire movement and on the building regulations to mitigate against fire risk.  The fire in a garment factory in a tall building claimed 146 lives, and directly led to new laws on building access and egress, fire proofing requirements, the availability of fire extinguishers, the installation of alarm systems and automatic sprinklers.

Under current fire safety legislation it is the responsibility of the person(s) having responsibility for the building to provide a fire safety risk assessment that includes an emergency evacuation plan for all people likely to be in the premises, including disabled people, and how that plan will be implemented. Such an evacuation plan should not rely upon the intervention of the Fire and Rescue Service to make it work.

Hospitality Industry Health Risks: Chicago Hotel Is Confirmed As Source For Three Cases Of Legionnaires' Disease

The city and the hotel are notifying the 8,500 guests who stayed there from July 16 through Aug. 15. Authorities say they’ve identified the source of the bacteria and there’s no ongoing health risk.

Health officials say they are investigating three confirmed cases of Legionnaires’ (LEE’-juh-nares) disease among people who stayed at a Chicago hotel. The Chicago Department of Public Health and the JW Marriott Chicago Hotel issued an advisory Tuesday. They say guests with symptoms who stayed at the Adams Street hotel should contact their doctors.

Symptoms include headache, high fever, chills, cough, chest pain and shortness of breath.

The bacteria that cause Legionnaires’ disease grow in water and can spread through vapor in air-conditioning ducts or mist from a whirlpool spa.
