Hospitality Industry Safety Risks: Pennsylvania Restaurant Owner Faces “Wrongful Death Lawsuit”; Man Suffered Cuts, Cardiac Arrest After Falling Thru “Plate Glass Door”

“…The complaint claims that (the restaurant owner) knew the glass doors were unsafe, and, “despite owning and operating the restaurant and premises for decades … never even attempted to make the plate glass entrance door even marginally safer, such as Hospitality Industry Wrongful Death Lawsuitsthrough the application of widely available safety films that are applied to glass and cost only a few dollars per square foot of coverage…(the victim) allegedly suffered several cardiac arrests and was pronounced dead at 2:03 p.m. due to “penetrating injuries to the neck leading to acute hemorrhagic shock.””

A widow blames hazardous plate glass for the death of her retired college professor husband who badly cut his throat on the shattered door of a sandwich shop.

Plate glass, also known as annealed glass, “constitutes a well-known safety hazard when broken because such glass can break into large, sharp and unreasonably dangerous jagged shards if impacted,” according to the complaint in Butler County, Pa.

Laminated or tempered glass is safer because it “fractures into small relatively harmless cubes that are less likely to cause significant injury,” the complaint adds.  Cynthia Brunken sued Bob’s Sub and Sandwich Shop, located in Slippery Rock Commons, and its owner Cindy Marlowe for wrongful death.

A national standard was officially recognized in 1966 and an act was created in Pennsylvania “Requiring the Use of Safety Glazing Materials.”

“Despite the known and obvious risks involved with the use of plate glass or annealed glass entrance doors, the glass entrance door used at the Bob’s Sub and Sandwich Shop restaurant on June 3, 2013 contained dangerous plate glass or annealed glass, and did not incorporate adequate or safer glazing material, rendering the glass door unreasonably dangerous to customers, business invitees and specifically, Glen W. Brunken,” according to the complaint.

Hospitality Industry Health Risks: North Carolina Hotel “Carbon Monoxide Poisoning Deaths” Tied To 2006 “Unpermitted Pool Water Heater” Replacement, Poor Ventilation System

“…the hotel, which was originally built in 2000, never applied for a permit, nor did they seek an inspection of the new pool water heater…State Hotel Carbon Monoxide Deathslaw requires a permit if businesses perform any alteration to indoor plumbing or heating…An 11-year-old Rock Hill boy died in room 225 at the Best Western Plus in Boone in early June. The toxicology report states the concentration of carbon monoxide in his blood was greater than 60-percent…An elderly couple staying in the same room died in April of carbon monoxide poisoning…”

Authorities in Boone say the Best Western Plus replaced the pool’s water heater without applying for a permit or requesting an inspection. The town of Boone Planning and Inspection Department says the Best Western Plus, the hotel where three people died of carbon monoxide poisoning, replaced the pool water heater in 2006.

The Planning and Inspection Department says the town is discussing having the fire department check all area hotels to ensure there are no other pool water heaters that have been replaced without their knowledge. Officials say this will be implemented in the near future.

Room 225 is directly above a storage room where pool chemicals are housed, and the pool’s water heating system lives. Authorities have blamed deficiencies in the natural gas water heater and the storage room’s ventilation system for the poisonous gas seeping into the guestroom directly above.

Hospitality Industry Legal Risks: Illinois Nightclub Sued By Man Stabbed In The Chest By Patron Who Was “Over-Served Alcohol”

“…(plaintiff) required emergency surgery after he was stabbed in the chest…the lawsuit says (he) suffered severe and permanent injuries and “will be hindered and prevented from attending to his usual duties and Alcohol Drink Responsiblyaffairs…the suit alleges that Olaska’s intoxication played a role in the stabbing. A restaurant employee was also injured in the fight…”

A man who was stabbed during a confrontation that cost a Naperville teacher his life has filed a lawsuit against the club where the clash happened. William Hayes III is suing Frankie’s Blue Room in Naperville and owner Riff Menza, claiming the bar over-served Daniel Olaska, who is awaiting trial on charges that he wounded Hayes and killed Shaun Wild in February 2012.

Authorities have said that Hayes had been teasing Olaska about drinking beer from a wine glass when Olsaka stabbed him with a folding knife he was carrying. Wild, a second-grade teacher at a Naperville school and a friend of Hayes’, was attempting to stop Olaska from leaving the bar when Olaska fatally stabbed him, according to police.

Hayes was a senior at nearby North Central College when the incident occurred. Wild was a 2010 graduate of the college. Both played for the school’s football team.

Hospitality Industry Health Risks: Data Reveals Few U.S. Hotels Have "Carbon Monoxide Alarms" Installed; 30 Incidents Of Elevated CO Levels Has Led To Evacuations And 8 Deaths

“…Few of the roughly 4.9 million rooms in 51,214 lodging properties with at least 15 rooms have (carbon monoxide) alarms…From 2010 through Nov. 8, 2102, there were 30 incidents of fire departments or government officials finding elevated levels of CO at U.S. hotels…in the 30 incidents, more than 1,300 people were evacuated, eight died, and at least 170 were affected by CO, treated by medical personnel or hospitalized…”

Neil Hampson was inside his room at a lodge in Alaska during a salmon fishing vacation three years ago when his carbon monoxide alarm sounded. Hampson, a Seattle doctor and expert on carbon monoxide, went to the basement and found the CO level four times higher. He says he turned off the gas for the water heater, and CO levels throughout the building “dropped precipitously.”

A plumber later found that the water heater was improperly vented, he says, and the lodge owner installed CO alarms in each sleeping room. Guests and staff at the lodge near Alaska’s Kenai River were fortunate Hampson carries an alarm which detects the odorless, colorless poison gas that can cause brain damage or be lethal.

Only a handful of state or municipal laws require them, although more than 1,300 people were evacuated nationally from hotels because of high CO levels in recent years.

CO, often called “the silent killer,” is such a threat that the National Fire Protection Association says CO alarms should be near bedrooms in every home.

Hospitality Industry Legal Risks: South Carolina Restaurant Group Pays $1.1 Million To Settle "Alcohol-Related Death" Lawsuit Caused By Assistant Manager

“…the 32-year-old (defendant) has just left his job as an assistant manager at Husk restaurant last December when he rear-ended a car being driven by 32-year-old Quentin Miller on the Ravenel Bridge. Miller died in the fiery wreck, and police say Burnell’s blood-alcohol level was 0.24 percent…”

The parent company of a Charleston restaurant will pay $1.1 million to the family of a man killed in a drunken driving crash that authorities say was caused by one of the restaurant’s employees.

The Post and Courier of Charleston reports the settlement calls for Miller’s parents to get $518,000, Miller’s common-law wife to get $91,500 and the remaining $490,000 to go to attorneys’ fees and costs. The settlement should be finalized at a hearing later this week.

Hospitality Industry Legal Risks: Chicago Hotel And Restaurant Sued For $500,000 In Wrongful Death Lawsuit

“…The 10-count lawsuit, which seeks more than $500,000 in compensation for Duskey’s wrongful death, names Hilton Worldwide, the Palmer House Hilton, Surreal Chicago and Adrenaline Y2K as the party hosts…Megan Duskey fell four floors to her death after she tried to slide down a railing at the Palmer House Hilton…”

The parents of a former Crete woman who fell to her death at a “Haunted Hotel Ball” at the Palmer House Hilton in Chicago in 2010 are suing the hotel and the event hosts. James and Deborah Duskey claim in a lawsuit filed Tuesday in Cook County Circuit Court that the death of their daughter Megan at the Halloween-themed ball was due to the negligence of the hotel and the event companies who hosted the party.

The lawsuit claims the hotel and event hosts allowed people at the ball to “consume unlimited amounts of alcoholic beverages” after they paid for a ticket and failed to provide security to protect the patrons of the ball.

Hospitality Industry Health Risks: West Virginia Hotel Evacuated After Carbon Monoxide Detected; One Guest Dies And Others Hospitalized

 

The Holiday Inn Express along Corridor G in South Charleston has been evacuated after carbon monoxide was detected inside the building.

Kanawha County 911 Dispatchers tell WSAZ.com a man was found dead in the hotel and three others taken to the hospital.

One man was seriously injured. The other two victims were taken to the hospital as a precaution.

 

A South Charleston Firefighter tells WSAZ.com the two men were found on the 5th floor of the hotel.

 

Firefighters say there were extremely high levels of carbon monoxide found on several floors of the hotel.

 

About 10 to 15 people were inside the hotel at the time of the evacuation.

 

Firefighters say the room where the two men were staying did not have a carbon monoxide detector. According to the Assistant Fire Chief, hotels are not required by law to have carbon monoxide detectors, only smoke detectors.

Hospitality Industry Legal Risks: Texas Hotel Sued By Family Of Housekeeper Who Died Falling Down Service Elevator Shaft; State Required Inspection Two-Weeks Overdue

“…Gloria Rodriguez, 65, had been an employee at the Crockett Hotel for 12 years when she fell six stories down the service elevator shaft Dec. 28. The elevator’s state-required annual inspection was more than two weeks overdue at the time…”

The family of a Crockett Hotel housekeeper who plunged to her death down an open elevator shaft last month has filed a wrongful death lawsuit.

Named in the suit are New Jersey-based Otis Elevator Company and 1859-Historic Hotels Ltd., a Galveston-based company that owns the Crockett Hotel and the nearby Menger Hotel in downtown San Antonio.

“Based upon current information, it is believed that she attempted to get on the elevator but when the doors opened there was no elevator, causing her to fall,” Houston-based attorney James Hada wrote in the suit, filed Wednesday.

Food Industry Risks: New York Tortilla Factory Ordered To Shut Down After Employees' Death And Discovery That Owners Did Not Carry Workers' Compensation Insurance

The state Workers Compensation Board issued a stop-work order at the Williamsburg facility after learning the factory’s owner, Erasmo Ponce, was not offering workers’ compensation insurance to his employees.

A Brooklyn tortilla factory where a man was crushed when he fell into a dough mixer has been temporarily shuttered, state officials said Friday. Tortilleria Chinantla was not closed because of Juan Baten’s gruesome death, but his loss of life did lead investigators to the facility, officials said.

“The owner would need to get the insurance and pay fines before he is permitted to reopen,” said agency spokesman Brian Keegan.

The Occupational Safety and Health Administration and the state Department of Labor are investigating the deadly accident. Baten, 22, reached into the mixer early Monday and was sucked inside after his hand was snagged by one of its blades. The young father was killed instantly when a turbine broke his neck.

Hospitality Industry Foodborne Illnesses: Poultry (17%), Beef (16%) And Leafy Vegetables Cause Most Illnesses Reported That Included 18 Deaths In 2007 In U.S.

Among the 497 foodborne outbreaks with a laboratory-confirmed single etiologic agent reported, norovirus was the most common cause, followed by Salmonella. Among the 18 reported deaths, 11 were attributed to bacterial etiologies (five Salmonella, three Listeria monocytogenes, two Escherichia coli O157:H7, and one Clostridium botulinum), two to viral etiologies (norovirus), and one to a chemical (mushroom toxin).

Foodborne agents cause an estimated 76 million illnesses annually in the United States (1). Outbreak surveillance provides insights into the causes of foodborne illness, types of implicated foods, and settings of foodborne infections that can be used in food safety strategies to prevent and control foodborne disease. CDC collects data on foodborne disease outbreaks submitted from all states and territories. This report summarizes epidemiologic data for the 1,097 reported outbreaks occurring during 2007 (the most recent finalized data), which resulted in 21,244 cases of foodborne illness and 18 deaths. Among the 497 foodborne outbreaks with a laboratory-confirmed single etiologic agent reported, norovirus was the most common cause, followed by Salmonella. Among the 18 reported deaths, 11 were attributed to bacterial etiologies (five Salmonella, three Listeria monocytogenes, two Escherichia coli O157:H7, and one Clostridium botulinum), two to viral etiologies (norovirus), and one to a chemical (mushroom toxin). Four deaths occurred in outbreaks with unknown etiologies. Among the 235 outbreaks attributed to a single food commodity, poultry (17%), beef (16%), and leafy vegetables (14%) were most often the cause of illness.
