Hospitality Industry Safety Risks: Texas Hotel Faces “Wrongful Death” Lawsuit; Guest Falls Off “Defective Treadmill”

“…During his stay, (the deceased) went to use the property’s exercise room where he got on a treadmill maintained by Exer-Tech, according to the Hospitality Industry Wrongful Death Lawsuitssuit…a “defective” condition in the treadmill caused him to fall and strike his head (causing) a serious injury to his head which in turn resulted in his death…”

The family of a man who allegedly sustained a fatal head injury while working out at a Houston hotel has pursued legal action, recent court documents say. The late William Lake III’s widow and their three minor children filed a lawsuit against Marriott Hotel Services Inc. and Exer-Tech Inc. in Harris County District Court on Nov. 14.

Houston federal court received the case on Dec. 18. At the time of the events of last May 15, Lake was a paying guest at the Houston Marriott George Bush Intercontinental Airport.

His survivors fault Marriott for failing to address the treadmill’s allegedly dangerous condition while Exer-Tech is blamed for allegedly failing to properly maintain and repair the device. Consequently, the plaintiffs seek unspecified monetary damages.

Hospitality Industry Safety Risks: Virginia Hotel Sued For $250,000 By Guest Who Fell Down Stairwell During Power Outage; No Emergency Lights Above Door To Stairwell

“…(the plaintiff) unknowingly stepped into a stairwell and fell 14 steps, according to the suit. It states there were no emergency lights above the door to the stairwell or on the stairwell itself. Christians claims he received permanent injuries, and continues to have physical pain, mental anguish and lost wages…”

A Loudoun County man is suing The Homestead in Hot Springs after falling down a flight of stairs during a power outage at the luxury hotel and spa. Allan Christian, of 20934 Winola Terrace, Ashburn, filed the $250,000 lawsuit Monday in U.S. District Court, according to online court records.

He was in one of the hotels’ restaurants at about 9 p.m. June 19, 2010 when the lights went out, leaving it “pitch black,” according to the complaint. Resort staff told Christian and other guests the lights would be on again soon, and served food to them, the complaint states. However, candles and flashlights weren’t handed out or placed in areas where people may need to walk, it states.

About 40 minutes after the power went out, Christian got up to move in the direction of the bathroom, and used “the furniture and staff to guide his movement,” the lawsuit states.

Hospitality Industry Guest Safety Risks: Child Dies From Fall From 5th Floor Balcony Of A Florida Hotel; Balcony Had 4-Foot High Railing With Tightly-Spaced Bars

“…Family members said the girl was on the balcony with two adult relatives and was playing with an inflatable toy, Bernstein said. The toy became wedged in the railing and she slipped through and fell…”

“…detectives were trying to determine how the child could have fallen from the balcony, which is secured by a 4-foot-high railing with tightly spaced bars that extend to the floor…”

A toddler who fell from a fifth-floor balcony at an Oceanfront hotel Friday night died Saturday. The girl fell from a balcony at the Sandcastle Oceanfront Resort Hotel and landed on a patio of the Ammos Authentic Greek Cuisine restaurant, said Officer Adam Bernstein, a police spokesman.

The names of the toddler and other family members are being withheld to give the family time to inform relatives and friends, Bernstein said. The girl’s family lives in Staunton.

“Everything right now is pointing toward horrific accident,” Bernstein said. “At this point, there’s no indication of any foul play or neglect.”

Hotel Industry Accident Risks: Guests At Two Florida Hotels Are Critically Injured And Die In Falls At Properties

The Auburn Villager has confirmed that Mary Beth Goodner, an Auburn University student and long-time Auburn resident, has died in an accident in Key West, Fla., during AU’s spring break. Allyson Crean, public information officer for the Key West Police Department, said the investigation is still open and the police report is not yet available.

  • Crean said Goodner, 22, fell down a spiral staircase at the hotel where she was staying in Key West. The call came in to the police department about 3:30 a.m., and Goodner was pronounced dead at the hospital this morning.

Authorities say a man is in serious condition after falling five floors from an Orlando hotel. Orange County Fire Rescue responded to the Friday incident at the Hilton Orlando near International Drive and State Road 528.

  • The man was taken to a nearby hospital. No additional details on the situation were available, except that the hotel doesn’t have balconies
