Hospitality Industry Risk Management Update: “Cause of Sickness Linked to Hotel Swimming Pool Remains Unclear”

“An inspector found that the pool’s pH levels were outside the ideal range Monday morning, but it was not clear that the issue was serious enough to sicken someonepool…The incident began about 8 p.m. Sunday when one of the children vomited and the others said they felt sick. They were all treated and released from the hospital by morning, a Children’s Health spokesperson said…”

The cause of a sickness that hospitalized 13 children after they used a hotel swimming pool Sunday night remained unclear Monday.

The pool at Homewood Suites, 4210 Airport Way, remained closed while the incident was investigated, the Denver Department of Environmental Health reported.

Hospitality Industry Legal Update: “Millbrook Hotel Faces Legionnaires Lawsuit”

“…The Wheat and Renta families, in the area for a local softball tournament, were among at least 14 people who became sick with flu-like symptoms including difficulty breathing, elevated temperature,Legionella-pneumophila body aches, dizziness, headaches, and chills, according to the suit…Legionnaires disease is typically contracted by inhaling or ingesting Legionella bacteria. The bacteria can also cause related illness, such as Pontiac fever, pneumonia, and other serious and sometimes permanent health conditions…”

Montgomery law firm Beasley-Allen has filed a personal injury lawsuit on behalf of two Jefferson County families, who the suit contends contracted Legionnaires disease while staying at the Sleep Inn & Suites in Millbrook.

Clayton Wheat and Tony Renta, along with several members of a girls’ softball team, became ill and several tested positive for Legionnaires disease after a weekend stay at the Sleep Inn & Suites, according to the suit filed by the Beasley Allen Law Firm in the U.S. District Court for the Middle District of Alabama.

Hospitality Industry Legal Update: “Blame Flies Over Drowning Death in Seattle Hotel Pool”

“…The lawsuit claims that Deboch’s body was dragged by suction from a pump to a drain in the middle of the deep end,WA pool where it was held for nearly three hours. The suit claims that the pump’s emergency shut-off, which would have released suction after detecting a blockage, had failed. The suit also claims poor water quality prevented rescue attempts by firefighters…”

The family of a man who drowned a year ago in the swimming pool at the Quality Inn & Suites Seattle Center has filed a wrongful-death suit against the owners of the hotel, claiming poor maintenance made the water unusually murky and contributed to a botched rescue operation by firefighters.

Jeannie Williams nearly died from a carbon monoxide leak in a hotel that claimed the life of her son Jeffrey Williams, and now she’s made it her life’s mission to make people aware of the killer.

Last spring, three people died from carbon monoxide poisoning after staying at the Blue Ridge Plaza Best Western Hotel in Boone, N.C. The victims—elderly couple Daryl and Shirley Jenkins and 11-year-old Jeffrey Williams—visited the property seven weeks apart and all stayed in room 225.

Though the initial investigation following the Jenkins’ deaths was inconclusive, toxicology reports eventually revealed that the deadly gas was to blame for the tragedies. The pool heater’s exhaust pipe, which ran directly under room 225, was the source of the lethal leak.

The Hilton chain of hotels and its related businesses are being sued after the death of 27 year old Raul Hernandez Martinez, who was electrocuted after using a swimming pool at the Hilton Houston Westchase Hotel. According to Chron.com, he and his relatives had been using the pool on the evening of August 31st 2013 when the pool lights turned on as it began to get dark.

People began to complain of being shocked by electrical current and a child that was swimming at the deep end began to get into difficulties. On swimming over to him to assist him, Mr. Martinez was shocked and began convulsing.  Although he managed to lift the child out of the water, he was unable to get out. When he was pulled out, he had gone into cardiac arrest. He died six days later in the intensive care unit of the local hospital.

Recently media exposure regarding the dangers of carbon monoxide poisoning in hotels, motels, and resorts has seemed to increase. The issue has garnered attention among such major media outlets as ABC News’ 20/20, USA Today, and CNN. With good reason – a 2013 USA Today Investigation showed that, “eight people have died and at least 170 others have been treated for carbon monoxide poisoning in the past three years in hotels.” A concerning statistic given that according to the United States Consumer Product Safety Comission, approximately 170 people die each year from carbon monoxide produced by non-automotive consumer products overall.

Carbon monoxide, also known as CO, is a colorless, odorless, gas with toxic consequences for people and animals. Carbon monoxide poisoning is a risk that hotel, motel, and resort operators must take seriously, most importantly to ensure the safety and well-being of guests. But also because of the potential legal exposure carbon monoxide poisoning poses, both to business entities and individual owners, should the unthinkable happen in their hotel.

An Ohio attorney whose body was found in a Palm Springs hotel room in November died of carbon monoxide poisoning, the Riverside County coroner’s office said Wednesday.

The Palm Springs Police Department has been investigating the death and will present its findings to the Riverside County district attorney’s office for possible criminal charges, said Palm Springs Police Lt. Mitch Spike.

REPORT FROM THE U.S.—Three deaths linked to a faulty pipe that allegedly exposed guests to a lethal dose of carbon monoxide at a Best Western in Boone, North Carolina, have hoteliers stressing the importance of carbon-monoxide safety.

With rare exceptions, hotels all have sources of carbon monoxide, sources said, and without proper installation, maintenance and inspection, hotel owners and managers could be putting their guests at risk.
